Terms of Service

These Terms of Service apply to the use of the Zandvoort Pass website, mobile application and related services. By creating an account, purchasing a pass, using the app or using any Zandvoort Pass service, you agree to these Terms of Service.

2. What Zandvoort Pass is

Zandvoort Pass is a digital tourist pass and local guide for visitors of Zandvoort.

The service may include:

  • access to local deals and discounts;
  • a digital pass;
  • QR codes or redemption codes;
  • tourist information;
  • routes and local recommendations;
  • practical guide content;
  • links to local businesses, maps and external services.

Zandvoort Pass is intended to help visitors discover and use local offers in and around Zandvoort.

3. Scope of these Terms

These Terms apply to:

  • the Zandvoort Pass website;
  • the Zandvoort Pass mobile app for iOS and Android;
  • user accounts;
  • digital passes;
  • paid and free services;
  • deal usage and validation;
  • QR codes and redemption codes;
  • content, routes, recommendations and guide information.

Additional terms may apply to specific purchases, app store transactions, third-party services or local business offers.

4. Eligibility

You may use Zandvoort Pass if you are legally able to enter into an agreement or if you use the service with permission from a parent or legal guardian.

You are responsible for making sure that your use of Zandvoort Pass is allowed under the laws that apply to you.

5. Account

The public website may be accessible without an account. The mobile app and pass functionality require an account.

When creating an account, you must provide accurate and complete information. You are responsible for keeping your login details secure.

You may not:

  • create an account using false information;
  • use someone else’s account;
  • share your account in a way that allows misuse of passes or deals;
  • attempt to bypass pass validation or deal restrictions.

We may suspend, block or delete an account if we reasonably believe that the account is being misused, used fraudulently or used in violation of these Terms.

6. Digital pass

A Zandvoort Pass is a digital product linked to your account.

The pass may have:

  • a specific validity period;
  • a start date and end date;
  • usage limits;
  • deal-specific restrictions;
  • availability restrictions;
  • conditions set by Zandvoort Pass or by participating local businesses.

You are responsible for checking the validity period and deal conditions before using the pass.

A pass does not guarantee that every listed deal, business, route, activity or recommendation will be available at all times.

7. Deals and local offers

Deals are provided in cooperation with participating local businesses.

Each deal may have its own conditions, such as:

  • validity dates;
  • valid days or times;
  • maximum number of uses;
  • one-time-use restrictions;
  • product or service restrictions;
  • minimum spend requirements;
  • reservation requirements;
  • age restrictions;
  • weather, capacity or seasonal limitations;
  • conditions set by the participating business.

You must check the conditions shown in the app before using a deal.

Deals may be changed, paused, withdrawn or become unavailable. This can happen, for example, because of business closure, stock limitations, weather conditions, technical issues, incorrect listing information or a decision by the participating business.

We aim to keep deal information accurate, but we cannot guarantee that every deal or business detail is always complete, current or error-free.

8. Using a deal

To use a deal, you may need to show a QR code, redemption code or pass number to a participating local business.

A deal is only valid if:

  • your pass is active and valid;
  • the deal is active and valid;
  • the deal has not expired;
  • the deal has not already been used where one-time use applies;
  • the applicable deal conditions are met;
  • the participating business accepts and validates the deal.

Once a one-time-use deal has been validated or marked as used, it cannot be reused.

You may not copy, sell, transfer, manipulate or misuse QR codes, redemption codes, pass numbers or deal validation systems.

9. Validation by local businesses

Participating local businesses may use a Zandvoort Pass check page or other validation method to check whether your pass or deal is valid.

When a deal is checked, the business may see limited information, such as:

  • your name;
  • your pass number;
  • whether the pass or deal is valid;
  • relevant deal information.

The final decision to provide a product, service, discount or benefit may depend on the applicable deal conditions and the business’s reasonable operational limitations.

If there is a dispute at a business location, you should contact Zandvoort Pass support. We will try to help, but we cannot force a participating business to provide an offer if the conditions are not met or if the offer is reasonably unavailable.

10. Prices and payments

Prices are shown before purchase. Prices may include or exclude taxes depending on how they are displayed at checkout.

Payments are processed by Stripe or another payment provider shown during checkout. We do not store full card numbers, bank account numbers or full payment credentials.

A purchase is completed when the payment provider confirms successful payment and the pass is issued or activated.

We may refuse, cancel or refund a purchase if we reasonably suspect fraud, technical abuse, payment issues or a clear pricing or product error.

11. App Store and Google Play purchases

If you purchase or download Zandvoort Pass through the Apple App Store or Google Play Store, the terms and payment rules of Apple or Google may also apply.

Refund requests for purchases made through Apple or Google may need to be submitted through the relevant app store, depending on the payment method and platform rules.

Apple and Google are not responsible for providing Zandvoort Pass services, support, deal fulfilment or local business offers.

12. Right of withdrawal and refunds

If you are a consumer in the European Union, you may have a statutory right of withdrawal for certain online purchases.

However, the right of withdrawal may not apply, or may end early, for digital content or digital services once performance has started with your consent and acknowledgement that you lose the right of withdrawal.

Because Zandvoort Pass is a digital service that can be accessed and used immediately after purchase, refunds may be limited once the pass has been activated, accessed or used.

We may offer a refund where required by law or where we consider it reasonable, for example in the case of:

  • duplicate payment;
  • technical failure preventing access to the pass;
  • incorrect charge;
  • cancellation by Zandvoort Pass before the pass is used.

We generally do not provide refunds simply because:

  • you did not use the pass;
  • you used fewer deals than expected;
  • a specific deal was unavailable;
  • a local business was closed;
  • the weather changed;
  • your travel plans changed;
  • you no longer want to use the service after activation.

To request a refund, contact us with your account email address, payment reference and reason for the request.

Nothing in this section limits any mandatory consumer rights you may have under applicable law.

13. Availability of the service

We aim to keep Zandvoort Pass available and working properly, but we do not guarantee uninterrupted or error-free service.

The service may be unavailable or limited because of:

  • maintenance;
  • technical problems;
  • internet or hosting issues;
  • app store issues;
  • third-party service issues;
  • security incidents;
  • force majeure;
  • updates or changes to the platform.

We may modify, suspend or discontinue parts of the service where reasonably necessary.

14. Tourist information, routes and recommendations

Zandvoort Pass may include tourist information, routes, guides, addresses, travel times, opening hours, recommendations and map links.

This content is provided for general information and convenience only. We try to keep it useful and accurate, but we do not guarantee that all information is complete, current or suitable for your specific situation.

You are responsible for checking important information yourself, such as:

  • opening hours;
  • accessibility;
  • weather conditions;
  • transport options;
  • safety;
  • prices;
  • reservation requirements;
  • local rules;
  • age restrictions.

You use routes, recommendations and guide content at your own responsibility.

15. Maps and third-party services

The app or website may contain links or buttons to external services such as Apple Maps, Google Maps, local business websites, social media pages or booking platforms.

These third-party services are not controlled by Zandvoort Pass. Their own terms and privacy policies apply.

We are not responsible for third-party content, availability, pricing, accuracy, data processing, products, services or actions.

16. Participating local businesses

Participating local businesses are independent third parties.

Zandvoort Pass helps users discover and access offers from these businesses, but Zandvoort Pass is not the seller or provider of the products or services offered by those businesses, unless explicitly stated otherwise.

The participating business is responsible for:

  • the quality of its products and services;
  • customer service at its location;
  • food, drinks, rentals, activities or other services it provides;
  • compliance with applicable laws and permits;
  • fulfilment of accepted offers;
  • safety and operational decisions at its location.

Complaints about a product or service provided by a local business should first be addressed to that business. You may also inform Zandvoort Pass, especially if a listed deal was refused without a valid reason.

17. Acceptable use

You may only use Zandvoort Pass for lawful and normal personal use.

You may not:

  • misuse, copy, resell or transfer passes or deal codes;
  • attempt to redeem a deal more often than allowed;
  • manipulate QR codes, redemption codes or validation results;
  • access systems without permission;
  • scrape, copy or extract app content at scale;
  • interfere with the security or operation of the service;
  • use automated systems to abuse the service;
  • impersonate another person;
  • submit false, misleading or harmful information;
  • use the service in a way that damages Zandvoort Pass, local businesses or other users.

We may block access, cancel passes or refuse service if we reasonably believe these rules are violated.

18. Intellectual property

All Zandvoort Pass branding, design, software, text, images, content, logos, databases, layouts and other materials are owned by Besance, licensed to Besance or used with permission, unless stated otherwise.

You may use the service for personal use only. You may not copy, reproduce, distribute, sell, modify, reverse engineer or commercially exploit any part of the service without prior written permission.

Local business names, logos, photos and content may belong to the relevant local businesses or licensors.

19. User feedback

If you send us feedback, suggestions, ideas or improvement requests, we may use them to improve Zandvoort Pass without owing compensation or credit, unless agreed otherwise in writing.

You confirm that any feedback you provide does not infringe the rights of others.

20. Privacy

Your use of Zandvoort Pass is also governed by our Privacy Policy.

The Privacy Policy explains what personal data we process, why we process it, how long we keep it and what rights you have.

21. Limitation of liability

We are responsible for providing Zandvoort Pass with reasonable care and skill.

To the maximum extent allowed by law, we are not liable for:

  • indirect damages;
  • loss of profit;
  • loss of revenue;
  • loss of data;
  • missed savings;
  • travel costs;
  • disappointment or loss of enjoyment;
  • unavailable deals;
  • temporary service interruptions;
  • actions or omissions of participating local businesses;
  • third-party services, websites, maps, app stores or payment providers.

Our total liability for claims related to a purchased pass is limited to the amount you paid for that pass, unless the law does not allow such limitation.

Nothing in these Terms excludes or limits liability where this is not allowed by law, including liability for intent, deliberate recklessness, death or personal injury caused by negligence, or mandatory consumer rights.

22. Indemnity

If you misuse Zandvoort Pass, violate these Terms or infringe the rights of others, you may be responsible for losses, damages, claims and costs that result from your actions.

This does not affect your mandatory consumer rights.

23. Changes to the service

We may update, improve, modify or remove parts of Zandvoort Pass from time to time.

This may include changes to:

  • app features;
  • deal availability;
  • participating businesses;
  • pass types;
  • pricing;
  • routes and guide content;
  • validation methods;
  • technical systems.

If a change materially affects a paid pass that you have already purchased, we will handle this in a reasonable way and in accordance with applicable consumer law.

24. Changes to these Terms

We may update these Terms from time to time.

The latest version will be available through the website or app. If we make important changes, we may notify you in a suitable way, such as through the app, website or email.

If you continue using Zandvoort Pass after the updated Terms apply, you accept the updated Terms.

25. Suspension and termination

You may stop using Zandvoort Pass at any time.

We may suspend or terminate your access to Zandvoort Pass if:

  • you violate these Terms;
  • you misuse passes, deals or codes;
  • your payment is reversed, cancelled or fraudulent;
  • we are required to do so by law;
  • we need to protect the service, users or participating businesses;
  • your account creates a security or fraud risk.

If your access is terminated because of misuse or fraud, you may lose access to your pass without a refund, unless applicable law requires otherwise.

26. Force majeure

We are not responsible for failure or delay caused by events outside our reasonable control, including but not limited to:

  • internet failures;
  • hosting failures;
  • payment provider failures;
  • app store issues;
  • government measures;
  • strikes;
  • extreme weather;
  • natural disasters;
  • pandemics;
  • power outages;
  • security incidents;
  • war, terrorism or civil unrest.

27. Complaints and support

If you have a complaint or support request, contact us through the contact details provided on the Zandvoort Pass website or app.

Please include:

  • your account email address;
  • your pass number, if relevant;
  • the deal or business involved, if relevant;
  • a clear description of the issue;
  • screenshots or payment references where useful.

We will try to respond within a reasonable time.

28. Delete account

You can request deletion of your Zandvoort Pass account and the related personal data.

To do so, send an email to [email protected] with the subject “Delete account”.

Include the email address you use for Zandvoort Pass in your message.

After receiving your request, we will delete or anonymise your personal data where possible. Some data may need to be retained for legal, tax, accounting, security or fraud prevention reasons.

Please note: after deletion, you may no longer be able to use your Zandvoort Pass and you may lose access to your pass or pass history.

29. Governing law

These Terms are governed by the laws of the Netherlands.

If you are a consumer, you may also have mandatory rights under the laws of the country where you live. These mandatory rights are not limited by these Terms.

30. Disputes

We prefer to resolve complaints directly.

If a dispute cannot be resolved, the competent court in the Netherlands will have jurisdiction, unless mandatory consumer law gives you the right to bring proceedings elsewhere.
